Terms of Service

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using Komut, you represent that you meet these requirements. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Komut is a social discovery platform that helps you define your daily commute route, explore others routes, and connect with people going the same way. Komut is not a transportation, ridesharing, or carpooling service: we do not provide vehicles, drivers, or transportation, and we do not arrange, manage, or guarantee any journey. Any arrangement you make with another user is solely between you and that user.

3. Accounts & Security

You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for all activity under your account and for keeping your credentials confidential. Notify us immediately at contact@komut.app if you suspect unauthorized access. You may not share, sell, or transfer your account to another person.

4. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not permit you to copy, modify, distribute, sell, lease, or create derivative works of the Service, or to remove any proprietary notices. The license terminates automatically if you breach these Terms.

5. Acceptable Use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• harass, stalk, threaten, defame, or impersonate other people;
• post content that is illegal, sexually exploitative, hateful, or that infringes others' rights;
• scrape, mine, or harvest data from the Service by automated means without our written permission;
• reverse engineer, decompile, or attempt to extract the source code of the Service;
• interfere with or disrupt the Service, including introducing malware or overloading our systems;
• use the Service for unsolicited advertising, spam, or phishing;
• misrepresent your identity, your route, or your affiliation with any person or organization; or
• help or encourage anyone to do any of the above.

6. User Content

You retain ownership of the content you submit to the Service ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute your User Content solely to operate, maintain, and improve the Service. You represent that you have the rights to your User Content and that it does not infringe the rights of others.

We may remove or restrict any User Content that violates these Terms, applicable law, or our community standards, and we may report content to law enforcement where required.

7. Safety & Other Users

Komut connects you with other people, but we do not background-check or endorse any user. You are solely responsible for your interactions with other users, including any arrangements to travel together. Exercise common sense, meet in public places when appropriate, and report suspicious or unsafe behavior through the app or the contact details below. We may take action against accounts that endanger others, including suspension or removal.

8. Credits, Fees & Payment

Komut is free for passengers. Drivers use credits to send or accept connection requests, and new accounts receive a sign-up credit bonus. Additional credits can be purchased in the app. Prices, credit packs, and billing rules are shown at the time of purchase and may change for future purchases.

Purchases made through Apple or Google are processed by the applicable app store and governed by its billing terms and refund policies. Credits are non-refundable and non-transferable except where required by law, and unused credits are forfeited when your account is deactivated. Fraudulent chargebacks may result in account termination.

9. Intellectual Property

The Service — including its software, design, text, graphics, logos, and trademarks — is owned by Digital Oasys Technologies LLC and protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted to you. If you provide feedback or suggestions, we may use them without restriction or obligation to you.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood it.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will match any particular user, route, or outcome. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or relating to your use of the Service. Our total liability for any claims relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim, or one hundred US dollars (USD $100) if you have not paid us. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your User Content, your arrangements with other users, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Service and deactivate your account at any time from the app. Deactivation hides your profile and removes you from discovery; as described in our Privacy Policy, we retain your account details, routes, and connection history after deactivation for security, enforcement of these Terms, and legal compliance. We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or legal exposure for us, or where required to protect users or the platform. Sections that by their nature should survive termination (including license limits, disclaimers, liability, indemnity, and governing law) will survive.

15. Governing Law & Disputes

These Terms are governed by the laws applicable where the Company is established, without regard to conflict-of-law rules. Before filing a formal claim, you agree to try to resolve the dispute informally by contacting us at contact@komut.app and we will try in good faith to resolve it within thirty (30) days. If you are a consumer, you also retain any mandatory rights you have under the law of your country of residence.

16. General Provisions

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
